1. Agreement to Terms

By accessing and using Deriv Copy ("the Platform," "our service," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our Platform.

These Terms constitute a legally binding agreement between you and Deriv Copy.

2. Eligibility

To use our Platform, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have a valid Deriv trading account
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information
• Reside in a jurisdiction where copy trading services are legal

3. Service Description

Deriv Copy provides an automated copy trading platform that:

• Replicates trades from expert traders to your Deriv account in real-time
• Uses WebSocket technology for instant trade execution
• Requires your Deriv API tokens for trade execution permissions
• Does NOT have access to withdraw or transfer your funds
• Provides subscription-based packages based on account balance limits

4. Account Registration and Security

4.1 Account Creation

To use our services, you must:

• Create an account with accurate and complete information
• Provide a valid email address
• Create a secure password
• Connect your Deriv account using API tokens

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your API tokens have appropriate permissions

5. Subscription and Payments

5.1 Package Selection

• Packages are based on your Deriv account balance
• You must select a package that matches your current balance
• Monthly and yearly subscription options are available
• Balance verification is required before purchase

5.2 Payment Terms

• Payments are processed through secure payment methods
• Subscriptions are billed in advance
• All fees are non-refundable unless otherwise stated
• We reserve the right to change subscription prices with 30 days notice

5.3 Renewals and Cancellations

• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds for partial billing periods

6. Trading and Risk Disclosure

6.1 Trading Risks

You acknowledge and accept that:

• All trading involves substantial risk of loss
• Past performance does not guarantee future results
• You may lose your entire investment
• Market conditions can change rapidly
• Copy trading does not eliminate risk

6.2 No Financial Advice

Our Platform:

• Does NOT provide financial, investment, or tax advice
• Is NOT a registered financial advisor or broker
• Does NOT guarantee profits or returns
• Recommends consulting with qualified professionals before trading

6.3 Your Responsibilities

You are solely responsible for:

• All trading decisions and their consequences
• Ensuring you understand the risks involved
• Managing your account balance and risk exposure
• Complying with all applicable laws and regulations
• Monitoring your trades and account activity

7. API Token Usage

By providing your Deriv API tokens, you grant us permission to:

• Execute trades on your behalf
• Access your account balance for verification
• View your trading history for analytics

Important: We only request tokens with trade execution permissions. We NEVER request or receive permissions to withdraw or transfer funds from your account.

8. Service Availability

We strive to maintain high availability but do not guarantee:

• Uninterrupted or error-free service
• That defects will be corrected immediately
• Compatibility with all devices or browsers
• Service during maintenance or upgrades

We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any trading losses
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in subscription fees in the past 12 months
• We are not responsible for third-party actions or Deriv platform issues
• We are not liable for losses due to your actions or negligence

10. Indemnification

You agree to indemnify and hold harmless Deriv Copy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of our Platform
• Your violation of these Terms
• Your violation of any laws or regulations
• Your trading activities and decisions

11. Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use automated bots or scripts (except as provided by us)
• Share your account with others
• Reverse engineer or copy our software
• Violate any applicable laws or regulations
• Manipulate or abuse our services

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Cancelling your subscription
• Requesting account deletion via email

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• We detect fraudulent activity
• You provide false information
• Required by law
• At our sole discretion with reasonable cause

12.3 Effects of Termination

Upon termination:

• Your access to the Platform will cease immediately
• All automated trading will stop
• Your data may be retained as required by law
• No refunds will be provided

13. Intellectual Property

All content, features, and functionality on our Platform are owned by Deriv Copy and are protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

You may not reproduce, distribute, modify, or create derivative works without our written permission.

14. Third-Party Services

Our Platform integrates with Deriv's trading platform:

• We are not affiliated with or endorsed by Deriv
• We are not responsible for Deriv's services or policies
• You must comply with Deriv's terms and conditions
• Links to third-party websites are provided for convenience only

15. Privacy

Your use of our Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

16. Modifications to Terms

We reserve the right to modify these Terms at any time:

• Changes will be posted on our Platform
• Material changes will be notified via email
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using our services

17. Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws.

17.2 Arbitration

Any disputes arising from these Terms or your use of our Platform shall be resolved through binding arbitration, except where prohibited by law.
